New Idea Hosting™ provides services to many types of clients (no "adult", gambling, or pyramid schemes or such) but we specialize in "business grade" hosting. That means "top-notch" speed, dependability, data backups, and security whether your site is business or not-you still get the benefits.
New Idea Hosting™ has the responsibility to protect each client and provide them with the best services available. The following guidelines are designed to insure these services.

Content:
All services provided by New Idea Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless New Idea Hosting from any claims resulting from the use of the service which damages the subscriber or any other party.

Examples of non-acceptable content or links

• Pirated software
• "Illegal MP3's"
• Hackers programs or archives
• Warez Sites
• Pornography in any form or similar "adult" content, either visual or textual.
• Racially Hateful or prejudicial content.
• "Hate" content of any type or form.
• Sites knowingly allowing libelous or slanderous content.
• HYIP, multi-level marketing, or any form of other questionable business schemes or investment offers.
• Any content deemed to possibly cause harm to the image of New Idea Hosting as an ethical, non-prejudicial host or deemed inappropriate or offensive to the general standards of the public. If you have questions about your site's content, ask first.

New Idea Hosting will be the sole arbiter as to what constitutes a violation of this provision. Violation is subject to termination without notice, refund, or recourse.

Software Security (user installerd-3rd Party)
New Idea Hosting requires that the account user be responsible for keeping all installed scripts & software (such as site builder, forums or blogs) updated to their latest version to maintain system security. In instances where this is not maintained by the user we reserve the right to notify you and then suspend sites with serious security problems until that software is upgraded/patched.
We are, of course, responsible for all server security upgrades & system patches and rarely some downtime may be required for re-starts or such to keep out systems up to date. This is considered "scheduled maintenance" and is usually performed on a week-night between 1am and 4am CST

Unlimited Traffic/Hits & Server Resource Usage:
New Idea Hosting is pleased to offer our clients unlimited traffic/hits, and server usage. Unlimited Traffic/Hits refers to the number of visitors to your website, NOT the amount of bandwidth/data transfer. Your account is still limited to the allotted disk space-bandwidth/data transfer included with your selected package. To maintain the integrity of our service the following traffic/usage limitations may rarely apply.

• Sites with banners, graphics or cgi's running from their domain being used on other domains.
• Sites with immense graphic archives or galleries.
• Sites offering download archives, such as .zip, .tar, .ra and .GZ.
• Sites running large chat room gatherings.
• Sites repeatedly using more than 15% of system resources (Note: Because our servers are so powerful with 8 cores of Xeon power and plenty of RAM 15% would be a LOT)

If you reach a state where you do not qualify for unlimited traffic/hits, your account may be required to be upgraded, or if system performance is affected in a manner where we cannot reach a solution that still provides full performance to all customers on a server New Idea Hosting may request you upgrade your account to reduce the load on our shared servers. If this rare situation should happen we will attempt to move you to a server or otherwise reposition your account where it is not causing a problem; we have everything from Virtual Servers to "Cloud" computing and dedicated servers at our disposal even though these are not our specialty. If the solution we offer for your ultra-high-traffic needs does not suit you; you will be refunded on a pro-rated basis for pre-paid charges for any unused service period and we will allow a reasonable time period for you to establish service with a host who provides packages suitable for your specific needs.
 
New Idea Hosting will be the sole arbiter as to what constitutes a violation of usage limitations. Bandwidth/data transfer may go unmonitored until you reach your account limit, then your account will be suspended pending your approval to auto-upgrade to the next level plan with greater data transfer, however it is our policy that you will receive a warning notice if nearing your bandwidth limits. (In 8 years no one has ever been "turned off" unexpectedly-we work with clients any way possible) 

Chat Rooms:
Some New Idea Hosting plans allow clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. We do provide a html based cgi chat room that runs without hindering the performance of the machine for others. You are free to run your own chat script, as long as it does not hinder server performance.

Background Processes/Programs
In almost all cases New Idea Hosting does not allow programs to run continually in the background or databases with persistent connections. If you have the need for such service we will consider your request on a one to one basis make a determination. If your request is granted extra charges may be incurred based on system resources used and operational maintenance needed.

Cron Jobs:
New Idea Hosting does allow Cron Jobs to be conducted on our servers within reason.
We also offer "1 click" full account download/backups but ask they not be used daily.

IRC:
New Idea Hosting does not allow IRC or IRC bots to be operated on our servers.

Multiple Connections:
Multiple ftp sessions are allowed, on a single hosting account.

Idle Timeouts:
New Idea Hosting may disconnect any idle connection to the network.
We do not generally allow persistent database connections such as those used optionally by some forum & similar software. If you are using a program with this option it should be disabled unless specific permission is granted for use in advance.
Average timeouts are:
FTP - 300 seconds

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from a New Idea Hosting account or using an email address that is maintained on a New Idea Hosting machine is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.
New Idea Hosting will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptable, as long as Opt-Out/Removal request are fully honored. We have professional mailing lit software available free on all plans. This software allows very large mailings (hundreds or thousands) without the following "regular" mail restrictions below.
Please make an effort to limit outgoing mail on your account to no more than 500 pieces per DAY and no more than 20 pieces per minute. Large mailings are preferred to be sent from the hours of 12AM - 8AM CST. Sites with large mailing databases, need to be placed on on a provider specializing in such services. We can gladly suggest some.

Server Abuse:
Any attempts to undermine or cause harm to a New Idea Hosting server or customer of New Idea Hosting is strictly prohibited. New Idea Hosting will pursue legal action to the fullest extent for any and all abuse of the New Idea Hosting Network.
Unintentional abuse by sites attracting "attacks" on our network is also cause for suspension to maintain system integrity until the situation can be investigated and appropriate action taken by the site owner. If instances continue you may be asked to find another service provider with allowance for backup & transfer of your data.  

Suspension/De-Activation:
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. New Idea Hosting reserves the right to remove any account without prior notice. If New Idea Hosting deactivates your account(s) for violating policy, your will forfeit your rights to a refund and none will be given. No refunds will be given for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.

Payment Policy
At the current time all New Idea Hosting services (excluding domain names) are payable on a monthly basis only. You have a personal account portal which stores all your payment information for your use if needed and you nay change your payment methods at ant time from your portal.
We may establish other payment options in the future and if we do all current customers will have the option of changing to any of the new payment options offered.

Account cancellation-Read Carefully. You Agree That:

1. Your account with NewIdea/PavementWeb can be cancelled ONLY by You using the cancel link in your monthly invoice or through your personal customer account portal.
   ANY Other method of cancellation are not valid. Our system is fully automated so telling us by phone or e-mail to "cancel" does not connect to that system. It is software and only "understands" instructions placed using it...to cancel or order; it controls our client-side services and your account (especially payment) information is encrypted and unavailable to us. All card/payment services are PCI Compliant.
2. Your personal portal contains cancellation instructions! There is no valid excuse for non-compliance with this section, the software will continue to bill you as scheduled until you tell it to stop by submitting a cancellation request.
3. Once you cancel the account will be terminated within 24 hours or at the end of the paid term depending on your selection. No pro-rated refunds are given for partial service periods.
4. NOTE: We do not offer domains to non-hosted clients. If you cancel all your hosting accounts with us you should move your domain names to another registrar before they expire.
5. Domain Renewal without hosting is $29.95 per domain, per year-no exceptions.

Privacy Policy
New Idea Hosting respects the privacy of every individual who visits our Web sites, responds to our interactive advertisements or sends us e-mail. This Privacy Statement outlines the information New Idea Hosting will collect and how we will use that information. This Statement will also instruct you on what to do if you do not want your personal information collected when you respond to our Web-based advertisements or send us email.

All order forms on New Idea Hosting utilize a Secure Socket Layer (SSL) or Secure Electronic Transaction (SET) protocol to provide "secure sessions" for our visitors. Through the "secure session," information that you input into a New Idea Hosting  order form will be sent and will arrive privately and unaltered at a New Idea Hosting server. This security prohibits other companies and Web users from being able to access your information.  ALL Credit Card Information is encrypted at the highest grade currently possible for civilian use.

New Idea Hosting will not collect any personally-identifiable information about you (that is, your name, address, telephone number, or email address) unless you provide it to us voluntarily.

The following are some examples of when New Idea Hosting may require that you provide personally-identifiable information:

• to complete an online order for a product or service (if you do not wish to complete an online order form, we will always provide an option for you to complete an order by telephone)
• to request more information about new or current New Idea Hosting products or services

If you do not want your personally-identifiable information collected, please do not submit it to us. If you have already submitted this information and would like for us to remove it from our records, please contact us at the email address listed at the bottom of this Statement. We will use reasonable efforts to delete your information from our existing files.

When you do provide us with personally-identifiable information, we may use that information in the following ways, unless stated otherwise:

• we may store and process that information to better understand all customer needs and how we can improve our products and services for all customers
• we may use that information to contact you with information about new promotions and general announcements for upgrades, service enhancement, maintenance notices, etc.
• we may contact you if we have questions about your account

New Idea Hosting will not ever sell or otherwise distribute your personally-identifiable information to third parties in any way or form, period.
